These Terms & Conditions apply to enquiries, reservations and private sailing experiences provided under the Linda Sailing brand.

By confirming a booking, paying a deposit or participating in a trip, you agree to these Terms & Conditions.

1. About Linda Sailing

Linda Sailing is the trading name of:

2. Enquiries and Booking Confirmation

Submitting an enquiry through the website does not create a confirmed booking.

A booking becomes confirmed only when:

  1. Linda Sailing has confirmed availability in writing;
  2. you have accepted the quotation and trip details;
  3. the required deposit or full payment has been received; and
  4. Linda Sailing has issued written booking confirmation.

Any provisional reservation may be released if payment is not received by the stated deadline.

3. Person Making the Booking

The person making the booking must:

  • be at least 18 years old;
  • have authority to make the booking for all guests;
  • provide accurate information;
  • communicate these Terms & Conditions to all guests;
  • be responsible for payments due under the booking;
  • ensure that all guests follow the captain’s instructions.

The booking contact is responsible for informing us promptly about any changes.

4. Prices

Prices are stated in the currency shown in the quotation or booking confirmation.

The confirmed price will specify what is included, which may include:

  • private use of the yacht;
  • captain and crew;
  • fuel for the agreed itinerary;
  • drinking water and refreshments;
  • meals or snacks where stated;
  • snorkelling or other equipment where stated;
  • marina or national park fees where stated;
  • transfers where expressly included.

Unless specifically stated, prices do not include:

  • accommodation;
  • flights;
  • private transfers;
  • national park or attraction fees;
  • optional activities;
  • gratuities;
  • personal purchases;
  • additional services requested during the trip.

Any applicable taxes or fees will be shown before booking confirmation.

5. Deposit and Payment

The deposit or full payment amount will be stated in the booking confirmation.

The remaining balance must be paid by the date shown in the booking confirmation.

If payment is not received on time, Linda Sailing may treat the booking as cancelled by the guest.

The guest is responsible for bank, currency-conversion or transfer charges unless otherwise agreed.

6. Cancellation by the Guest

Cancellation requests must be made in writing by email or WhatsApp and are effective when received and acknowledged by Linda Sailing.

Unless different terms are stated in the booking confirmation, the following cancellation policy applies:

  • More than 14 days before departure: refund of amounts paid, less any non-recoverable payment or third-party costs;
  • Between 7 and 14 days before departure: 50% of the total booking price is payable;
  • Less than 7 days before departure: the booking is non-refundable;
  • No-show or cancellation on the day: the full booking price is payable.

A change of date is subject to availability and is not guaranteed.

Where a date change is accepted, additional charges may apply if prices or third-party costs have changed.

We recommend that guests obtain suitable travel insurance covering cancellation, illness, injury, transport disruption and other unforeseen circumstances.

7. Weather and Sea Conditions

Safety takes priority over the planned itinerary.

The captain has final authority regarding:

  • departure;
  • sailing route;
  • destination;
  • anchorage;
  • swimming or water activities;
  • return time;
  • any other operational or safety decision.

Routes and destinations shown on the website are examples and are not guaranteed.

Weather, sea conditions, tides, visibility, port restrictions or instructions from authorities may require Linda Sailing to:

  • delay departure;
  • change the route;
  • change the destination;
  • shorten or modify an activity;
  • return early;
  • postpone the trip;
  • cancel the trip.

A change of route made for safety reasons does not automatically entitle the guest to a refund.

8. Cancellation by Linda Sailing

Linda Sailing may cancel or postpone a trip because of:

  • unsafe weather or sea conditions;
  • mechanical or technical issues;
  • illness or unavailability of essential crew;
  • restrictions imposed by a marina, port or public authority;
  • force majeure or circumstances outside our reasonable control.

Where Linda Sailing cancels a trip before departure and cannot provide a suitable alternative, the guest may choose:

  • a replacement date;
  • a credit for a future trip; or
  • a refund of the amount paid to Linda Sailing for the cancelled trip.

Unless required by applicable law, Linda Sailing is not responsible for indirect costs such as flights, accommodation, visas, transport or missed activities.

9. Force Majeure

Linda Sailing is not liable for failure or delay caused by circumstances outside its reasonable control, including:

  • severe weather;
  • natural disasters;
  • epidemics or public health restrictions;
  • fire;
  • war or civil unrest;
  • government action;
  • port or maritime restrictions;
  • strikes;
  • interruption of essential services;
  • emergency rescue operations;
  • unexpected closure of destinations.

We will make reasonable efforts to offer a fair alternative, credit or rescheduling option where practical.

10. Departure and Late Arrival

Guests must arrive at the agreed meeting point at the stated time.

Late arrival may:

  • reduce the duration of the trip;
  • affect the planned route;
  • result in missed activities;
  • be treated as a no-show where the delay makes departure impractical.

The yacht may need to return at the originally scheduled time even when guests arrive late.

No refund is provided for time lost because of late arrival by a guest.

11. Guest Numbers

The number of guests must not exceed the number confirmed in the booking or the lawful capacity of the vessel.

Linda Sailing’s standard private charter capacity is up to 10 guests unless otherwise confirmed in writing.

Additional or substituted guests must be approved before departure.

12. Health, Safety and Accessibility

Guests must inform Linda Sailing before departure of any matter relevant to safe participation, including:

  • serious allergies;
  • medical conditions;
  • pregnancy;
  • reduced mobility;
  • recent surgery or injury;
  • special accessibility requirements.

Providing this information does not guarantee that every request can be accommodated.

The captain may refuse or limit participation in an activity where it would create an unreasonable safety risk.

All guests must:

  • follow safety briefings;
  • use safety equipment when instructed;
  • follow the captain’s and crew’s directions;
  • behave responsibly onboard;
  • supervise children at all times.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

13. Children

Children are welcome only when included in the confirmed booking.

A parent or responsible adult must supervise children at all times.

The captain may require children to wear life jackets during all or part of the trip.

Parents and guardians are responsible for deciding whether the experience is appropriate for a child, taking into account weather, duration and sea conditions.

14. Guest Conduct

Guests must behave respectfully toward the crew, other guests, the vessel, wildlife and the marine environment.

Linda Sailing may refuse boarding or end participation where a guest:

  • creates a safety risk;
  • refuses to follow crew instructions;
  • behaves aggressively or abusively;
  • damages the yacht or equipment;
  • possesses illegal items;
  • is impaired to a degree that makes participation unsafe;
  • engages in unlawful conduct.

Where participation is refused or ended because of guest conduct, no refund is required unless applicable law provides otherwise.

15. Food, Allergies and Dietary Requests

Guests must disclose allergies and dietary requirements before the trip.

We will make reasonable efforts to accommodate requests but cannot guarantee an environment completely free from allergens.

Guests with severe allergies should carry any medication or emergency items prescribed to them and inform the crew before departure.

16. Swimming and Water Activities

Swimming, snorkelling and other water activities depend on weather, location, guest ability and the captain’s approval.

Guests participate in water activities at their own risk and must:

  • follow crew instructions;
  • use provided safety equipment;
  • stay within designated areas;
  • honestly assess their swimming ability.

A guest should not enter the water if they feel unwell, unsafe or unable to participate confidently.

17. Personal Belongings

Guests are responsible for their personal belongings.

Linda Sailing is not responsible for loss of or damage to phones, cameras, jewellery, luggage or other personal items unless the loss was caused by negligence for which liability cannot lawfully be excluded.

Guests should protect electronic devices from water, movement and weather.

18. Damage to the Yacht

Guests may be responsible for reasonable repair or replacement costs where damage is caused intentionally, recklessly or through a serious failure to follow crew instructions.

Guests are not responsible for normal wear and tear.

19. Photography and Media

Guests may take photographs for personal use provided that this does not interfere with safety, privacy or the operation of the yacht.

Linda Sailing will not use identifiable images of guests for advertising without permission, except where the guest has separately agreed or deliberately participated in promotional content.

Permission may be withdrawn for future use by contacting us.

20. Third-Party Services

Some services may be supplied by independent third parties, including:

  • transport providers;
  • restaurants and caterers;
  • activity operators;
  • marinas;
  • payment providers;
  • national parks or attractions.

Where a third party provides a separate service under its own terms, Linda Sailing is not responsible for matters outside its reasonable control, subject to applicable law.

21. Website Information

We make reasonable efforts to keep website descriptions, photographs, prices and availability accurate.

Images are illustrative. Weather, lighting, yacht setup, food presentation, destinations and conditions may differ from photographs.

Website content does not form a binding booking until it is included in written booking confirmation.

22. Liability

Linda Sailing is responsible for providing the confirmed service with reasonable care and skill.

To the maximum extent permitted by law, Linda Sailing is not responsible for:

  • losses caused by inaccurate information supplied by a guest;
  • failure to follow safety instructions;
  • guest conduct;
  • personal property damage not caused by our negligence;
  • events outside our reasonable control;
  • indirect or consequential losses.

Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot legally be limited.

23. Complaints

Guests should raise any concern with the captain or crew as soon as possible so that we have an opportunity to resolve it during the trip.

Formal complaints should be sent within 14 days of the trip to:

  • booking name;
  • trip date;
  • booking reference;
  • description of the issue;
  • relevant photographs or supporting information.

24. Governing Law

These Terms & Conditions and any dispute relating to a booking are governed by the laws of Thailand.

The parties will first attempt to resolve disputes through good-faith communication.

Where a dispute cannot be resolved, it will be submitted to the competent courts of Thailand, subject to any mandatory consumer rights that apply.

25. Changes to These Terms

We may update these Terms & Conditions from time to time.

The version applicable to a booking is normally the version available when the booking was confirmed, unless a change is required by law or agreed with the guest.
